By creating an account, signing in, or otherwise using uStreamers (the "App", the "Service"), you enter into a binding agreement with uStreamers (a software service developed and operated by its proprietor and development team domiciled in the City of Córdoba, Province of Córdoba, Argentine Republic) and represent that you have read, understood, and agreed to these Terms of Service and the Privacy Policy. If you do not agree with any of these terms, you must not use the Service.
2. Description of the Service
uStreamers is a live-streaming client and aggregator that lets you:
View metadata and status of Twitch and Kick channels.
Participate in a real-time chat merged across supported platforms.
Send ephemeral voice notes and audio alerts to the streamer using your device's microphone in the mobile app or browser extension.
Integrate comments, room events (followers, likes, shares), and gift metrics from TikTok LIVE into creator broadcast tools (OBS control dock, on-screen stream overlay, and, to the extent supported and authorized through official APIs, the mobile app).
Operate creator broadcast tools: OBS control dock paired via secure QR code, visual stream overlay with a confidential access token, and browser extension for chat.
Receive notifications when a favorite channel goes live.
Moderate, if you have permissions on your channel, your community's chat.
Co-stream ("Streamear Juntos") and personalize your profile and chat through the optional paid subscription uStreamers Plus+.
Automatically synchronize and publish channel rankings ("Tops" of bits, subscriptions, and donations) to Discord channels via incoming webhooks configured voluntarily by the streamer (with daily updates in the free standard tier, and accelerated cadences available to uStreamers Plus+ subscribers).
uStreamers does not host or transmit video: live video and audio come directly from Twitch, Kick, and TikTok, independent platforms with their own terms of service.
3. Eligibility, Minimum Age, and Minor Users
3.1. Minimum Age Requirement
Access to and use of uStreamers is strictly restricted to individuals who are at least thirteen (13) years of age. If you are under 13 years old, you are not authorized to use the application, create an account, participate in chat rooms, or submit any personal information. uStreamers does not knowingly collect or solicit personal information from children under 13.
3.2. Minors Aged 13 to 17 (Parental Supervision)
If you are between the ages of 13 and the legal age of majority in your jurisdiction of residence (typically 18), by using the Service you represent and warrant that you have obtained the prior, express, and documented consent of your parent or legal guardian. The parent or legal guardian assumes full responsibility for the minor's actions, omissions, chat interactions, and any purchases made within uStreamers.
3.3. Purchases and Subscriptions (uStreamers Plus+)
Any paid subscription or in-app purchase made by a minor requires the express authorization of the owner of the payment method used. uStreamers does not issue refunds for transactions approved through the mobile device's own security mechanisms (Face ID, fingerprint, or store password).
3.4. Third-Party User-Generated Content
uStreamers acts as a technological aggregator and intermediary that relays metadata, chats, and live streams provided by third-party platforms (Twitch, Kick, and TikTok). Users and their legal representatives acknowledge that live content broadcast by external streamers may include coarse language, mature themes, or adult content. Users have access to in-app tools to block and report inappropriate content.
3.5. Termination of Unauthorized Minor Accounts
If uStreamers becomes aware, or has a well-founded suspicion, that an account was created by or is being used by a person under 13 years of age (or under the applicable digital consent age in their country without parental consent), it will promptly and without prior notice suspend the account permanently and irreversibly anonymize or delete all associated personal data.
By signing in with Twitch or Kick, you already declared to those platforms that you are at least 13 years old (their own terms of service require it). uStreamers is nonetheless directly responsible for its own user base and independently enforces every rule in this section.
4. Accounts, Authentication, and Platform Linking
uStreamers does not offer native sign-up: primary access and account creation is granted exclusively through federated (OAuth 2.0) authentication from Twitch or Kick. You are responsible for keeping your credentials on those platforms confidential and for any activity that occurs in uStreamers through your linked account.
4.1. Linking and Unlinking TikTok
Streamers may voluntarily link their TikTok accounts using the official authorization flow provided by TikTok for Developers under the following explicit terms:
Satellite Addon Status: The linked TikTok account operates strictly as a supplementary channel for chat and live event ingestion. TikTok does not enable registration or create an autonomous streamer account within uStreamers.
Unrestricted Unlinking: Streamers may disconnect their TikTok account at any time from the app Settings. Unlinking TikTok does not suspend, degrade, or delete the user's uStreamers account, which remains backed by their primary platform.
Immediate Credential Revocation: Upon unlinking, encrypted access tokens are immediately purged from our active stores and real-time live event listening is discontinued.
4.2. TikTok Virtual Items, Coins, and Gifts
uStreamers renders real-time stream overlays and metrics for gifts and coins (*Coins/Diamonds*) received via the TikTok LIVE API. Regarding these items:
uStreamers does not sell, purchase, exchange, or intermediate financial transactions for TikTok Coins or Gifts. All virtual items are purchased and governed exclusively within TikTok pursuant to its Virtual Items Policy.
uStreamers does not provide cashout services or creator remuneration for TikTok gifts.
Using TikTok gift alerts in uStreamers for gambling, lotteries, or unauthorized raffles is strictly prohibited.
5. Third-Party Content and No Pre-Screening
Live streams shown in uStreamers are broadcast and moderated by their respective streamers on Twitch or Kick. uStreamers does not control or pre-filter that content before it airs. The age rating and content policies of each source platform (Twitch, Kick) continue to apply.
5.1. Streamer Broadcast Tools (OBS Dock, Overlay, and Browser Extension)
For creators and broadcasters using our auxiliary streaming tools:
Confidentiality and Custody of Overlay URLs: The stream overlay URL contains a secret access token enabling the rendering of live chat and visual alerts inside broadcasting software (such as OBS Studio or Streamlabs). The streamer is solely responsible for maintaining the confidentiality of this URL and preventing its accidental exposure on stream. Broadcasters may immediately revoke and regenerate this token at any time within the app's Settings if exposure or unauthorized access is suspected.
OBS Control Dock: The dock interface connects via secure QR code pairing. Active dock sessions are isolated and can be revoked by the streamer at any time from their mobile device.
Browser Extension: The browser extension runs locally within the user's browser environment, communicating with official platform pages to enhance the chat experience without altering third-party servers or collecting banking credentials.
Channel Rankings, Bits, and Donation Disclaimers: Channel leaderboards (Tops for bits, subscriptions, donations, and streaks) reflect events reported by third-party platforms or the streamer for informational and community engagement purposes only. uStreamers does not operate as a financial institution, bank gateway, or payment processor for donations transferred between viewers and creators, nor does it administer, sell, hold in custody, or refund Twitch Bits, direct Twitch/Kick channel subscriptions, or third-party virtual currencies, which are governed entirely by each issuing platform's policies.
6. User-Generated Content (UGC), Images, and Voice Alerts
uStreamers allows certain users and creators (in particular streamers with an active uStreamers Plus+ subscription) to upload and post their own content on the Service, including text and images in the Community feed, avatars, and profile personalizations ("User Content" or "UGC").
6.1. Content Ownership and License
You retain full ownership of intellectual property rights in the images and text you post. However, by uploading or publishing User Content to uStreamers, you grant uStreamers a worldwide, non-exclusive, royalty-free license to store, host, process, resize, compress, transmit, and publicly display such content solely to operate and deliver the Service.
6.2. Zero Tolerance for Objectionable Content
uStreamers maintains a strict zero-tolerance policy toward abusive, harmful, or unlawful material. You are strictly prohibited from posting, transmitting, or uploading images or text that contain:
Explicit sexual content or pornography: Full or partial nudity, genitalia, explicit sexual acts, or pornographic material of any kind.
Child Sexual Abuse Material (CSAM): Absolute zero tolerance. Any detection will lead to immediate and irreversible account termination, permanent deletion of content, and mandatory reporting to law enforcement authorities and the National Center for Missing & Exploited Children (NCMEC).
Graphic violence or gore: Depictions of severe violence, excessive blood, mutilations, animal cruelty, or encouragement of suicide or self-harm.
Hate speech and harassment: Attacks or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality, as well as threats, defamation, or doxxing.
Third-party rights infringement: Photographs, artwork, or trademarks for which you do not hold valid ownership or authorization.
6.3. Automated and Human Moderation
uStreamers employs automated visual inspection filters (SafeSearch adult/violence detection APIs) and human review to detect and intercept prohibited material. uStreamers reserves the sole right to reject, block, or delete any image or post that violates these Terms, at any time and without prior notice or liability.
6.4. In-App Safety Features: Reporting and Blocking
In compliance with Apple App Store (Guideline 1.2) and Google Play Store policies:
In-app reporting (Report): Every post containing an image provides an accessible button for users to report objectionable material. The moderation team reviews reports and takes corrective action within a target response window of under 24 hours.
User blocking (Block): Users can block any creator or user at any time to immediately hide their posts, images, and chat messages in the application.
6.5. Live Voice Alerts and Audio Messages
uStreamers enables viewers to send real-time voice notes and audio alerts via their device's microphone to be broadcast live on a streamer's channel. By using this feature, you expressly agree to the following terms:
Public Broadcast and Distribution License: You grant uStreamers and the recipient streamer an express license to record, process, play live on air, and publicly broadcast your voice message in the live stream and in any subsequent recordings (VODs) or video clips.
Acoustic Modification and Voice Effects (Voice FX) Consent: You expressly authorize digital sound processing, pitch shifting, acoustic effects (e.g., robot, helium, echo, or distortion filters), and acoustic modulation of your voice according to filters selected by you or configured on the channel, and you waive any claims alleging impairment or violation of moral rights or the integrity of your voice in connection with such modifications.
Originality and Non-Infringement Warranty: You warrant that your audio does not contain copyrighted phonograms or music without proper authorization, pornographic or sexually suggestive sounds, ear-damaging or excessively loud noises, threats, harassment, or hate speech.
Non-Biometric Nature: uStreamers does not extract acoustic vectors, voiceprints, biometric templates, or identity profiles from your voice (in strict compliance with the Illinois Biometric Information Privacy Act - BIPA and GDPR Article 9).
Ephemeral Lifecycle and Notice-and-Takedown: Audio recordings are retained on an ephemeral basis and are automatically purged from our cloud storage servers within a maximum of 48 hours. Broadcasters and channel moderators are provided with real-time controls (including emergency mute and panic-button deletion) to immediately suppress or request urgent removal of any audio that breaches these Terms.
7. User Conduct, Chat, and Technical Security
By using uStreamers' merged chat, you agree not to post illegal content, hate speech, harassment, spam, or to impersonate others. uStreamers provides tools to block other users and report messages or accounts, including well-founded suspicions that an account belongs to an unauthorized minor. Administrators and moderators may warn, mute, temporarily or permanently suspend, or remove content from any account that violates these Terms.
7.1. Prohibition of Reverse Engineering, Scraping, and Technical Tampering
You agree not to engage in, attempt, or facilitate any of the following activities:
Decompiling, disassembling, reverse engineering, or attempting to discover the source code, architecture, or underlying protocols of the uStreamers mobile application, browser extension, or backend APIs.
Using automated mechanisms (such as bots, crawlers, spiders, scrapers, or automated scripts) to collect data, scrape profiles, simulate user traffic, or interact in bulk with the chat or Service endpoints.
Circumventing, disabling, tampering with, or bypassing any technical security controls, digital signatures, authentication tokens (including stream overlay tokens and webhooks), request rate limiting, or access controls safeguarding uStreamers Plus+ features.
Transmitting viruses, worms, Trojan horses, logic bombs, or any malicious code designed to disrupt, overload, impair, or compromise the operation of the Service or connected third-party systems.
8. Subscriptions and Purchases (uStreamers Plus+)
uStreamers Plus+ is an optional paid subscription that unlocks profile and chat personalization (exclusive colors, animated backgrounds, sending GIFs, image uploads in community posts, among other features) and advanced creator automation tools (including accelerated, high-frequency synchronization —every 15 minutes, 1 hour, or 6 hours— of channel rankings to Discord communities, whereas the free standard tier is limited to once-daily updates). Purchases are processed through the corresponding app store's payment mechanisms (Apple App Store or Google Play Store) and are governed, in addition to these Terms, by that store's billing terms.
Any subscription purchased by a minor is deemed to have been made with the authorization and consent of the owner of the payment method used (see section 3.3).
8.1. Automatic Renewal, Cancellation Policy, and Non-Refundable Fees
Subscriptions to uStreamers Plus+ automatically renew for successive renewal periods equivalent to the subscription term initially selected (monthly or annual), unless auto-renew is disabled at least twenty-four (24) hours prior to the conclusion of the current billing cycle through the user's Apple App Store or Google Play Store account settings.
To the fullest extent permitted by applicable law, all subscription purchases and fees are final and non-refundable once digital benefits have been accessed. This provision does not prejudice mandatory statutory consumer withdrawal rights in jurisdictions where applicable (such as the 14-day statutory right of withdrawal in the European Union, which expires early once digital performance begins with the consumer's express consent).
9. Intellectual Property, DMCA, and Feedback
uStreamers' brand, design, code, and graphic elements are the property of its developers. The names, logos, trademarks, emotes, and audiovisual content of Twitch, Kick, TikTok, and Discord belong to their respective corporate parents (Twitch Interactive, Inc., Kick Gaming, ByteDance Ltd. / TikTok Inc., Discord Inc.) or their respective creators, and are displayed in uStreamers strictly for interoperability purposes to provide the Service.
9.1. DMCA Notice-and-Takedown Procedure
uStreamers respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international standards. If you are a copyright owner (or authorized agent) and believe that an image or content hosted on uStreamers infringes your copyright, you may submit a formal notification to legal@ustreamers.app with the subject "DMCA Copyright Infringement Notice", containing:
Identification of the copyrighted work claimed to have been infringed.
Identification of the allegedly infringing material and its precise location on the Service (URL, post ID, or screenshot).
Your contact details (full name, mailing address, telephone number, and email address).
A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner.
A physical or electronic signature of the copyright owner or their authorized agent.
Upon receipt of a valid notice, uStreamers will expeditiously remove or disable access to the infringing material.
9.2. Repeat Infringer Policy
Pursuant to its intellectual property policy, uStreamers will terminate or permanently suspend the accounts of creators or users who repeatedly infringe third-party copyrights.
9.3. Unsolicited Ideas, Suggestions, and Feedback License
We welcome community suggestions and ideas to enhance the Service. However, if you submit any feedback, feature requests, design concepts, or technical suggestions ("Feedback"), you acknowledge and agree that such Feedback is provided on a purely voluntary, non-confidential basis, without any expectation of compensation or recognition. By submitting Feedback, you grant uStreamers a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, implement, commercialize, modify, and exploit such Feedback in any medium and for any purpose without any obligation to credit or compensate you.
10. Suspension, Deletion, and Termination of Accounts
uStreamers may suspend or terminate any account that violates these Terms, including but not limited to: accounts held by users under 13, fraudulent use, chat abuse, uploading prohibited content, or violation of Twitch's, Kick's, or TikTok's terms. You may delete your own account at any time from Settings; deletion is irreversible and anonymizes or permanently deletes your associated personal data and media assets.
10.1. Survival of Terms
All provisions of these Terms which by their nature should survive cancellation, suspension, or termination of an account shall remain in full force and effect following termination of the Service, including without limitation: Content and Feedback licenses (Sections 6 and 9.3), warranty disclaimers and limitations of liability (Section 11), user indemnification (Section 12), dispute resolution, governing law, and class action waiver (Section 14), and miscellaneous provisions (Section 15).
11. Limitation of Liability and Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by applicable law, uStreamers does not guarantee the continuous availability of third-party streams or third-party APIs and is not liable for the content, conduct, or transactions of streamers or users outside its direct control.
Third-Party Platform Disclaimer: uStreamers is an independent software application and is not endorsed, sponsored, affiliated with, or administered by Twitch Interactive Inc., Kick Gaming, TikTok Inc., ByteDance Ltd., or Discord Inc. Use of third-party APIs and webhooks is governed strictly by their respective Developer Terms and Community Guidelines.
No Commercialization or Sale of Third-Party Data: uStreamers does not sell, lease, or commercialize data of users or connected third-party platforms (Twitch, Kick, TikTok, Discord). Optional paid subscriptions such as uStreamers Plus+ compensate solely for access to software infrastructure, server computing resources, design formatting, and creator automation tooling, and under no circumstances constitute the sale or licensing of third-party data or APIs.
11.1. Disclaimer of Consequential Damages and Monetary Liability Cap
To the maximum extent permitted by applicable law, in no event shall uStreamers, its developers, directors, contractors, or infrastructure providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to: loss of profits, lost revenue, lost sponsorship opportunities, business interruption, loss of goodwill, lost data, or computer failure, even if advised of the possibility of such damages.
Notwithstanding anything to the contrary herein, uStreamers' total cumulative aggregate financial liability arising out of or relating to these Terms or the use of the Service (whether under contract, tort, negligence, warranty, or otherwise) shall be strictly capped at the greater of: (a) the total amount actually paid by you to uStreamers for subscriptions in the twelve (12) months preceding the event giving rise to liability, or (b) fifty United States dollars (USD $50) or its local currency equivalent.
11.2. Force Majeure and Third-Party API Changes
uStreamers shall not be liable for any delay, failure in performance, or interruption of the Service resulting from causes beyond its reasonable control, including but not limited to: unilateral decisions, API deprecations, rate limits, or outages by Twitch, Kick, TikTok, or Discord; failures of cloud infrastructure, hosting providers, or telecommunications networks; natural disasters; wars; acts of terrorism; pandemics; or governmental actions.
12. User Indemnification
You agree to defend, indemnify, and hold harmless uStreamers, its developers, owners, directors, contractors, and agents from and against any claims, lawsuits, administrative proceedings, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:
Your access to, use of, or inability to use the Service.
Any content, images, chat messages, or voice alerts that you transmit, upload, or broadcast through uStreamers.
Your breach or alleged breach of any provision of these Terms or the Privacy Policy.
Your infringement or violation of any third-party right, including intellectual property, copyright, trademark, trade secret, privacy, publicity, or moral rights.
Your breach of the terms of service, developer agreements, or community guidelines of Twitch, Kick, TikTok, or Discord in connection with your activity on the Service.
13. Changes to these Terms
uStreamers may update these Terms to reflect regulatory, technical, or Service changes. Material changes will be communicated within the app. Continued use of the Service after an update constitutes acceptance of the new Terms.
14. Dispute Resolution, Binding Arbitration, and Governing Law
14.1. Mandatory Pre-Dispute Informal Resolution Process
Before initiating any formal legal proceeding, arbitration, or lawsuit, you and uStreamers agree to first attempt to resolve in good faith and on an informal basis any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute").
To initiate this informal process, the claiming party must deliver a formal written Notice of Dispute to the other party. Notices addressed to uStreamers must be sent by email to legal@ustreamers.app with the subject line "Notice of Dispute", including: (a) your username and account email address, (b) a detailed factual description of the nature and basis of the claim, and (c) the specific relief or remedy sought. Both parties agree to negotiate in good faith for a mandatory period of thirty (30) calendar days following receipt of the Notice of Dispute before either party may commence arbitration or litigation.
14.2. Governing Law and Residual Judicial Forum
These Terms and any Dispute shall be governed by and construed in accordance with the laws of the Argentine Republic, without giving effect to any principles of conflicts of law. Subject to the binding arbitration provisions set forth herein and unless mandatory statutory consumer protection laws in your jurisdiction require otherwise, any residual judicial proceedings shall be submitted to the exclusive jurisdiction of the Ordinary Courts with Commercial competence seated in the City of Córdoba, Province of Córdoba, Argentine Republic.
14.3. Binding Individual Arbitration Agreement
If the Dispute cannot be resolved through the informal resolution process (§14.1), you and uStreamers agree that any unresolved controversy, claim, or dispute shall be definitively and exclusively settled by binding individual arbitration administered by a recognized arbitration provider or pursuant to the International Commercial Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL) or the International Centre for Dispute Resolution (ICDR / AAA) for users residing outside Argentina.
The arbitral award shall be final, binding, and non-appealable, and judgment upon the award may be entered and enforced in any court having jurisdiction. The arbitrator shall have exclusive authority to resolve all threshold questions regarding the interpretation, applicability, scope, or enforceability of this arbitration agreement.
Small Claims Court Exception: As an alternative to arbitration, either party may bring an individual action in a small claims court of competent jurisdiction, provided the claim qualifies within that court's monetary limits and remains individualized.
14.4. Express Class Action Waiver and Jury Trial Waiver
To the fullest extent permitted by applicable law:
Class Action Waiver: All dispute proceedings, whether in arbitration or in court, will be conducted solely on an individual basis. Neither you nor uStreamers shall have any right or authority to consolidate claims, commence class action lawsuits, or litigate any dispute as a plaintiff, representative, or class member in any class, collective, or representative proceeding.
Jury Trial Waiver: Both you and uStreamers knowingly, intentionally, and irrevocably waive any constitutional and statutory rights to a trial by jury in any judicial proceeding arising out of or related to these Terms or the Service.
14.5. Mass Arbitration Batching Protocol
To ensure orderly, cost-effective case administration, if twenty-five (25) or more coordinated individual arbitration demands presenting similar claims are filed by the same legal counsel or associated law firms against uStreamers ("Mass Arbitration"), the demands shall be administered in consecutive batches of no more than 25 cases at a time. The arbitration provider shall appoint independent arbitrators and set individual briefing schedules for each batch sequentially, while all administrative filing fees and deadlines for subsequent batches remain stayed until the preceding batch is resolved.
14.6. 30-Day Opt-Out Right
You have the right to opt out of and not be bound by this binding arbitration agreement and jury trial waiver. To exercise your opt-out right, you must deliver written notice by email to legal@ustreamers.app within thirty (30) calendar days of creating your uStreamers account (or within 30 days of the effective date of this update if you were an existing user). Your notice must state your full name, username, account email address, and an unambiguous statement declaring: "I opt out of the uStreamers binding arbitration agreement". If you opt out, disputes will be resolved exclusively before the judicial courts set forth in section 14.2.
14.7. Contractual Statute of Limitations (One-Year Bar)
To the maximum extent permitted by applicable law, any claim or cause of action arising out of or related to these Terms or the use of the Service must be formally filed within one (1) year after the cause of action accrued. If a claim is not brought within this one-year period, such claim or cause of action shall be permanently barred and extinguished.
14.8. Emergency Injunctive Relief and Intellectual Property Exception
Notwithstanding the informal dispute resolution requirement (§14.1) or arbitration (§14.3), uStreamers reserves the immediate right to petition any court of competent jurisdiction for temporary restraining orders, preliminary or permanent injunctive relief, or equitable remedies without waiting for the 30-day negotiation window in matters involving intellectual property infringement, trade secret misappropriation, cyberattacks, automated scraping, or unauthorized access to platform credentials or security tokens.
14.9. Online Dispute Resolution for European Union Consumers (ODR)
Pursuant to EU Regulation No. 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers residing in the European Union, accessible at: https://ec.europa.eu/consumers/odr. For any pre-dispute inquiries or claims, our official contact email is legal@ustreamers.app.
15. Severability, Entire Agreement, and No Waiver
15.1. Severability
If any provision of these Terms is determined to be unlawful, void, or for any reason unenforceable by a court or authority of competent jurisdiction, such provision shall be reformed to the minimum extent necessary to make it valid and enforceable while preserving its economic and legal intent, and the remaining provisions of these Terms shall remain in full force and effect.
15.2. Entire Agreement
These Terms of Service, together with the Privacy Policy, constitute the complete, final, and exclusive agreement between you and uStreamers regarding the Service, superseding all prior or contemporaneous communications, negotiations, representations, or agreements, whether oral or written.
15.3. No Waiver
The failure or delay of uStreamers to exercise or enforce any right, remedy, or provision of these Terms shall not operate as a waiver of such right or provision, nor shall any single or partial exercise preclude any other or further exercise thereof.
15.4. Export Controls and Sanctions Compliance
